Many buyers do not realize that traditionally, in the home buying process, real estate agents represent the interests of the seller, not the buyer. Yes, even after driving buyers around for hours and showing them many properties, when it came time for the actual purchase, the agent was representing the interests of the seller; unless the buyer and agent had entered into a buyer agency relationship. In Georgia, when buyer and agent enter into an agency relationship, a buyer's brokerage agreement must be executed and that relationship must be disclosed in the written offer to purchase, informing all parties that the buyer's agent is representing and negotiating on behalf of the buyer's interest. There is no added cost to the buyer to enter into the buyer agency relationship. The commission is still paid by the seller. The buyer agency relationship is a process that starts well before finding the buyer's home and continues well after it. Some uninformed buyers might think that if their agent wasn't with them when the buyer came across a house they were interested in, that their agent "must not be working for them".
